46,061 were stolen in 2012 compared to 46,667 in 2011 and the recovery rate was just 39%.  There were 548 motorcycle makes included in the 46,061 thefts in the country in 2012.

ALERT! A Year-Long Delay of Online Enrollment for Small Businesses

The Obama administration announced today a year-long delay of online enrollment for small businesses looking to purchase health coverage through federal-run exchanges, according to reports.
An HHS notice, reported by Politico, says the Department will continue serving small employers offline “while we concentrate on both creating a smoothly functioning online experience in the SHOP Marketplace, and adding key new features, including an employee choice option and premium aggregation services, by November 2014.” Small businesses have been able to apply through paper applications since Oct. 1.

Last month, HHS said online enrollment would be available “sometime in November.” 
 
The delay applies only to the federal-run SHOP exchanges in almost three dozen states.

AIR: Insured Losses from Typhoon Haiyan Up to $700 Million

Catastrophe modeler AIR Worldwide estimates insured losses from Typhoon Haiyan at between $300 million and $700 million. The estimate differs from that of rival modeler Eqecat, who said insured losses from the typhoon are likely not to exceed $100 million.

IRS Modifies "Use-it or Lose-it" Rule for Flexible Spending Arrangements (FSAs)

The Internal Revenue Service (IRS) released a notice on October 31 which modifies the “use-it or lose-it” rule for health flexible spending accounts (health FSAs) to allow a $500 annual carryover of unused contributions. This carryover provision serves as an alternative to the existing “grace period” rule.
Effective immediately, employers may amend their health FSAs to allow an annual carryover of up to $500. Employers wishing to adopt the carryover provision for the 2013 plan year must amend their cafeteria plans by the end of the 2014 plan year.
Employers may also amend their Section 125 plan to allow off-cycle changes in health plan enrollment elections for plans that do not follow a calendar year.

Furniture Market Follow Up

The October 2013 High Point Market recently concluded and the overall mood was very positive with reports from many we talked to of great success in orders taken.  Optimism is a word that for many years was not part of the discussion around our market and so it is exciting to hear of positive outlooks for the industry future.  The year started with the concern over the Governor's first draft of the NC State Government budget showing an allocation to the market of approximately 50% less funds from the previous budget.  ultimately the final draft included $1.85 million in state funds directed to the High Point Market.  What was the result of this $1.85 million "investment" in market?  Doug Clark of the Greensboro News & Record recently published "The Mighty Market" article summarizing the economic impact to the region.  The link to this article is here:

Model Notice of Exchange: Notice to New Employees

Employers subject to the Fair Labor Standards Act (FLSA) must provide notice to employees of Marketplace coverage by October 1, 2013. The technical release required employers to provide the Marketplace notice to all employees, regardless of plan enrollment or eligibility status or of part-time or full-time status. However, employers are not required to provide a separate notice to spouses or dependents eligible for coverage under the plan.

While all current employees should have received the new Marketplace notice no later than October 1, 2013, employers will also be required to distribute the notice to new employees on the start date or within 14 days of the start date.

BCBSNC Launches First Accountable Care Alliance for Southeastern North Carolina

Blue Cross and Blue Shield of North Carolina, along with New Hanover Regional Medical Center (NHRMC) and Wilmington Health (WH), have agreed to launch an Accountable Care Alliance to enhance care and provide a greater value for health care consumers in southeastern North Carolina.

This alliance is the first of its kind in North Carolina, and brings together a leading hospital system, several independent multi-speciality clinics, and an insurer to better meet the health care needs of patients in the area.

Blue Cross Blue Shield of North Carolina's Contract with Wayne Memorial Hospital to End December 5

After more than a year of contract negotiations, the contract between Blue Cross Blue Shield of North Carolina and Wayne Memorial Hospital in Goldsboro, N.C., will end on December 5, 2013.

Blue Cross Blue Shield- 60 Day State of Disaster for Select Counties

From July 12 to July 27, 2013, six counties in North Carolina were impacted by severe weather, and were declared by the Governor as a State of Disaster for 60 days. Those impacted include Alexander, Burke, Caldwell, Iredell, and Lincoln counties.

On Monday, August 12, 2013, Blue Cross Blue Shield of North Carolina released a statement that they will provide a 30 day delay for members, customers, and providers in meeting any contractual or state legal obligations that become due between August 7, 2013 and October 5, 2013 in the disaster area.

Medical Loss Ratio (MLR) Rebates

Beginning in June and by August 1st, health care providers will be mailing rebate notices and checks to policyholders and subscribers whose plans are due a rebate under the Minimum Medical Loss Ratio provision of the Affordable Care Act. The provision in the ACA requires health insurance issuers to submit data on the proportion of premium revenues spent on clinical services and quality improvement, which is otherwise known as the Medical Loss Ratio (MLR). This MLR requires insurance companies to spend at least 80% or 85% of premium dollars on medical care.

In most cases, for group plans, the rebate checks will be sent directly to the policyholder. Some insurance issuers will have satisfied the MLR requirements and will not be issuing rebate checks. Your Senn Dunn consultant will advise you on the handling of these rebates.

Employer Mandate Under Affordable Care Act Postponed to 2015

The federal government announced on July 2nd that it will delay the implementation of the employer mandate penalties (also referred to as "Play or Pay") and reporting requirements until 2015.
Leading up to 2015, the Obama Administration intends to simplify two requirements under the Affordable Care Act: Informational reporting under Sections 6055 and 6056 of the IRS.
Section 6055 reporting is required of insurers and self-insured plans. Section 6056 reporting is generally applied to some large employer groups with respect to the health coverage offered to their full-time employees. Employers are encouraged to implement these new requirements on a voluntary basis in 2014 in preparation for 2015.

Additional guidance on these two requirements is expected to be communicated later this summer.

Supreme Court Rules DOMA Unconstitutional

On June 26th, 2013, the United States Supreme Court struck down the federal law that defined "marriage" as a legal union between one man and one woman as husband and wife, and "spouse" as a person of the opposite sex who is a husband or wife. These definitions, which were outlined in the Defense of Marriage Act (DOMA), limited the rights, benefits and responsibilities deliberated by over 1,000 other federal laws to married couples in heterosexual unions.
